Seasonal rental

These general conditions of sale govern the rental of furnished tourist accommodation, located in Javea in Spain, accessible to individuals and businesses through the website www.luxury-villas-javea.com, and are intended to define the rights and obligations of landlord and tenant.

They are an integral part of the seasonal rental contract that binds the owner and the tenant.

Contract Purpose

The purpose of these Terms and Conditions are to set the contractual conditions between:

Accommodation address

The exact address of the accommodation and the access instructions will be provided after validation of the reservation.

Stay Dates

This accommodation is rented to you for a defined period during your booking, determined in your rental contract. Under no circumstances may a traveler claim any right to remain in the premises outside this period.

  • Arrival from 4 p.m.
  • Departure no later than 11 a.m.

People accommodated

The villas covered by this rental must not, under any circumstances, be occupied by a number of people greater than that indicated at the time of booking, except with the prior agreement of the owner or his agent. If necessary, the lessor or his representative may claim additional rent, or refuse entry to the villas.

Parties and large gatherings of all kinds are strictly prohibited..

For the night :

  • Additional travelers must be approved in advance.
  • They may be subject to additional charges, as indicated in our ratings.

Rent and charges

The amount of the rent and any charges is indicated on the booking form. The amount of the deposit is paid during booking, the balance must be paid no later than 15 days before the start date of the rental.
No tourist tax is currently requested by the municipality.


The booking will only be validated upon receipt of the deposit/advance payment (if the reservation is made more than 15 days before arrival on the premises) or of the full rent and charges (if the reservation is made 15 days or less before arrival). in places).


Cancellation by the tenant

Full refund up to 60 days before arrival

In the event of booking cancellation up to 60 days before arrival, the amount incurred will be fully refunded.

Partial refund between 60 days and 30 days before arrival

A 50% refund applies up to 30 days prior to arrival.

Less than 30 days before arrival

No refund will be made after this period.

Cancellation by owner

Cancellation made within 48 hours of booking

Since the accommodation is offered for rent on other holiday rental sites, and in order to avoid double bookings, the owner reserves the right to cancel the booking within 48 hours of the order, by proceeding to a full refund of the amount paid, without compensation or indemnity, or by offering other dates of stay.

Health context

En cas de situation de confinement ou limitation/ interdiction de déplacement imposés par le pays du locataire durant les dates de séjour, la politique d’annulation reste la même que sans un contexte sanitaire. (Voir paragraphe sur « Annulation par le locataire »)
In the event of a situation of locked down or limitation/prohibition of travel imposed by the country of the tenant during the dates of stay, the cancellation policy remains the same as without a health context. (See paragraph on “Cancellation by the tenant”)

Payment methods accepted

Accepted payment methods are listed in the booking form.

Security deposit

When a booking is made for one of our villas, a security deposit of €500 is required.

The security deposit, non-bearing of interest, cannot in any way be allocated to the payment of the rent or considered as such. It is used to respond to damage that may be caused to objects furnishing the rented villas.

In the absence of charges or rental repairs made necessary by the rental, the return of the security deposit will be made within 15 days after the end of the occupation of the accommodation.

Otherwise, the security deposit refund will be made within a minimum period of 60 days, after deducting the amount due by the Tenant for charges or rental repairs. If the amount paid is insufficient, the Tenant will pay any additional amount based on supporting documents by the Lessor and this within 30 days.

The owner, for his part, undertakes to justify the necessary amount for the restoration of the accommodation. In the event of non-amicable settlement, an expertise will be made and the court will be seized. It is the District Court of the place of rental that is competent.


The tenant must be insured against rental risks, theft, fire, water damage and recourse by neighbors and have the furniture rented out insured (either through his own insurance contract covering the risks of seasonal rental, or by subscribing to a special insurance policy for the entire duration of the rental).


We hope your stay will be filled with laughter, games and lively discussions. However, for the respect of the neighborhood, we ask you to limit the sound volume inside and outside the property.

  • Please avoid making noise between 10 p.m. and 8 a.m.to allow neighbors to sleep peacefully.
  • If neighboring residents report excessive noise or unruly behavior,we may have to evict you from our propertyand terminate the vacation rental agreement. This could result in loss of security deposit and rental amount.


We make sure to offer you a perfectly clean and tidy accommodation. During your stay, the tenant is required to respect the cleanliness of this property. A cleaning fee at the end of the stay is included in the rental price. This is detailed when booking.


  • Do not smoke inside (even by the window), because the smell of cigarettes takes a very long time to get rid of afterwards.
  • Discovering that someone has smoked inside the property will result in the loss of the security deposit.

Bedding and linens

  • This accommodation is rented with bedding (box springs and mattresses), duvets and pillows, as well as the corresponding sheets. To ensure the cleanliness of the bedding, it is imperative to always use suitable mattress pads and sheets.
  • Sheets, towels and other linens (bath mats, tea towels, etc.) are provided according to the number of people given when booking.

Use of premises

  • The supply of water, electricity and heating is included in the rental price. However, in order to best respect the environment, please turn off the lights when you leave a room, do not let the water run unnecessarily, and do not leave doors and windows open if you use the heating.
  • Please do not throw anything in the toilet, except toilet paper.
  • You can freely use the material made available to you, except for items contained in locked private storage.
  • Pets are not allowed. However, subject to the prior agreement of the lessor, certain animals may be accepted.

Household waste

  • Garbage cans are available to you. Please respect the sorting rules in force in the country.
  • When you leave, be sure to take out your household waste.


  • When leaving the villas, be sure to close all the windows and lock the doors of the villas. You are responsible for any theft and damage in the event of non-compliance with this clause.
  • Never leave children unattended, inside or outside the accommodation and near the swimming pool/jacuzzi.
  • In the event of an emergency, please notify the local emergency services.

Damage or malfunction

  • In case of accidental damage, don’t panic, it can happen! It is essential to keep us informed immediately.
  • In case of malfunction, please contact us without delay. We will then do our best to remedy the situation. No reimbursement for troubleshooting or repairs can be taken into account without our prior agreement.

Non-compliance with the rules

We have established these rules so that each tenant can stay with us safely and, above all, have a good time.

  • Non compliance with any of these house rules constitutes a violation of the terms of occupancy, as per the current terms & Conditions.
  • We reserve the right to expel from the property any guest or visitor who refuses to comply with these rules.
  • In any case, please use common sense during your stay. If you are unsure of the interpretation of any of the rules and need clarification, please give us a call.


This contract and its consequences are subject to Belgian law.
